Terms of service

Memory Stamp is operated by Clicking Awesome ("Memory Stamp," "we," "us"). These terms explain the rules for using Memory Stamp's website, stamp pages, Memory Box service, Memory Keepers program and family funds. By using Memory Stamp, you agree to them. If you don't agree, please don't use the service.

Your account

You must be at least 18 to create an account. You're responsible for activity on your account, so keep your sign-in secure and let us know if you think someone else has accessed it.

Your memories stay yours

You own the photos, videos, stories and other content you add. To host and show it, you give Memory Stamp permission to store, copy, display and process your content, including creating the tributes, prints and keepsakes you request, and only for running and improving the service for you. You can delete your content at any time.

You confirm you have the right to share what you upload, and that sharing it doesn't violate anyone's privacy or rights. Be especially careful with photos of living people and children.

What's not allowed

• Content that is illegal, hateful, harassing, sexually explicit or that exploits anyone
• Content you don't have the rights to, such as copyrighted music on public pages
• Pretending to be someone else, or creating a page or fund about a person to mislead or defraud
• Interfering with the service or other people's use of it

We may remove content or suspend accounts that break these rules.

AI-recreated content

Animated photos, tribute videos and AI-styled portraits are artistic recreations, not real footage. We label them as AI-recreated. Results vary and may not perfectly match the people or pets in your photos; we offer revisions as described at purchase. Please don't use AI-recreated content to deceive anyone.

Plans, orders and payments

• Prices are shown before you pay. Payments are processed securely by Stripe.
• Subscriptions renew automatically until you cancel. You can cancel any time, and you'll keep access until the end of the period you paid for.
• Forever plans keep one stamp page hosted for the life of the service, and include an archival export so your memories are never locked in.
• Custom keepsakes and tributes are made just for you, so they're non-refundable once production starts, but we'll fix or replace anything that arrives damaged or wrong.

Memory Box and the archive vault

• We send you a Memory Box with prepaid shipping to us. Package items carefully and keep a list of what you send.
• We digitize and restore items with care, but old, fragile or damaged items, especially tapes and discs, can fail during handling or playback. We'll let you know if something can't be digitized.
• If you choose vault storage, we keep your originals in a secure, climate-controlled archive while your vault plan is active. If a vault plan ends unpaid, we'll contact you and give at least 60 days to arrange return shipping before any further action.
• Return shipping of originals is charged at the time you request it.
• Our liability for physical items is limited to the amount you paid for that box's service, unless you purchase added insurance. Please don't send irreplaceable items you aren't comfortable shipping.

Family funds and gifts

• Family funds are reviewed before they go live. Organizers must tell the truth about who the fund is for and how money will be used.
• Gifts are paid to the verified organizer, minus any fees shown before you give. Gifts are personal gifts, not charitable donations, and are not tax-deductible.
• Gifts are generally non-refundable, except where a fund is found to be fraudulent.
• Gifts to Memory Stamp's children's fund go alongside our pledge of 10% of profits to support children living with incurable diseases. We publish an annual giving report.

Memory Keepers

Memory Keepers are independent contractors, not employees of Memory Stamp. Keepers agree to a background check and a family-privacy pledge. Memory Stamp handles booking and payment, but each Keeper is responsible for their own work and conduct.

Our service

We work hard to keep Memory Stamp running and your memories safe, but the service is provided "as is." We can't promise it will always be available or error-free, so we encourage you to keep your own backup of important files. To the extent the law allows, Memory Stamp isn't liable for indirect or consequential damages, and our total liability is limited to what you paid us in the past 12 months.

If we ever shut down the service, we'll give account holders at least 90 days' notice and a way to download everything.

Changes to these terms

We may update these terms. If changes are important, we'll notify account holders by email before they take effect.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules.
